Right of Withdrawal for Consumers

Consumers within the meaning of § 13 BGB (German Civil Code) have the right to withdraw from a contract for digital services within fourteen (14) days without giving any reason.

A consumer is any natural person who enters into the contract for purposes that are predominantly outside their trade, business, or profession.

Withdrawal Period

The withdrawal period is 14 days from the date of contract conclusion.

Exercise of Withdrawal Right

To exercise your right of withdrawal, you must notify us:

by means of a clear statement (e.g., by email) of your decision to withdraw from this contract.

To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we will reimburse all payments we have received from you without undue delay and no later than 14 days from the day on which we received notification of your withdrawal.

For this reimbursement, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise.

Expiry of Withdrawal Right for Digital Use (SaaS)

The right of withdrawal expires prematurely if:

  • we have begun the execution of the digital service and
  • the user has expressly agreed that we begin execution before the expiry of the withdrawal period and
  • the user has confirmed that they lose their right of withdrawal upon commencement of use.

For Fragly, this applies in particular from the moment when:

  • the user makes active requests to the AI assistant
  • monthly usage limits, query quotas, or technical access restrictions are triggered or consumed
  • the service is functionally used (not just registration or login)

Mere registration or login without active use does not yet lead to the expiry of the right of withdrawal.

No Right of Withdrawal for Entrepreneurs (B2B)

The right of withdrawal does not apply to entrepreneurs within the meaning of § 14 BGB.

An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding the contract, acts in the exercise of their commercial or independent professional activity.

Voluntary Refunds

Beyond the statutory rights of withdrawal, there are no voluntary refunds or goodwill arrangements unless expressly agreed otherwise in writing.
